1. INTRODUCTION

Welcome to Harvest Hub Garden ("Harvest Hub," "Platform," "we," "us," or "our"), a multivendor marketplace connecting gardeners, farmers, cottage food producers, and consumers interested in locally grown produce, gardening supplies, cottage foods, and related products.

These Terms and Conditions ("Terms") govern your access to and use of the Harvest Hub Garden platform, including our website, mobile application, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

2. DEFINITIONS

• Cottage Food Products refers to non-potentially hazardous foods prepared in a home kitchen that are allowed to be sold directly to consumers under applicable cottage food laws.
• Listing means a product or service listed by a Seller on the Platform.
• Member means a person who completes our account registration process or otherwise uses the Platform.
• Buyer means a Member who purchases products or services from Sellers on the Platform.
• Seller means a Member who offers and sells products or services on the Platform.
• User means a Member, visitor, or other person who uses the Platform.
• User Content means any Content that Users post, upload, submit, distribute, or otherwise communicate to or through the Platform.

3. ACCOUNT REGISTRATION AND ELIGIBILITY

3.1 Account Creation

To access certain features of the Platform, you must register for an account. When you register, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy. We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not responsible for any losses due to stolen or hacked passwords.

3.3 Eligibility

You must be at least 18 years old to create an account and use our Services. By using our Services, you represent and warrant that you meet this requirement. If you are creating an account on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

3.4 One Account Per User

Each user is limited to one active account. If we detect duplicate accounts, we reserve the right to merge or deactivate duplicate accounts at our discretion.

4. SELLER TERMS

4.1 Seller Registration

To sell products on Harvest Hub Garden, you must register as a Seller and provide additional information, which may include:

• Business name and contact information
• Business identification numbers and tax information
• Applicable licenses, permits, and certifications
• Banking information for receiving payments
• Location information for local marketing
• Product information, including growing practices and ingredients

4.2 Compliance with Laws and Regulations

Sellers must comply with all applicable laws and regulations, including but not limited to:

• Cottage food laws and regulations in their state/locality
• Food safety and labeling requirements
• Agricultural regulations for farm products
• Tax collection and reporting obligations
• Consumer protection laws
• Environmental regulations

4.3 Product Listings

Sellers are solely responsible for:

• Accurately describing their products
• Setting fair and transparent prices
• Providing complete ingredient information
• Disclosing allergens and potential cross-contamination
• Maintaining inventory and availability status
• Proper labeling according to applicable laws
• Providing accurate growing practices information

We reserve the right to remove any listings that violate these Terms, our community guidelines, or applicable laws.

4.4 Licensing and Certification Verification

Sellers of cottage foods, processed foods, and certain agricultural products must provide proof of applicable licenses, permits, and certifications. Harvest Hub Garden may verify this information and display verification status to Buyers.

Sellers agree to:

• Provide current and valid documentation
• Update documentation before expiration
• Comply with any changes in regulatory requirements
• Respond promptly to verification requests
• Cease selling products if required permits lapse

4.5 Seller Fees and Payments

Sellers agree to pay all applicable fees as outlined in our Fee Schedule, which may include:

• Platform commission on sales (percentage of transaction)
• Subscription fees (if applicable)
• Listing fees (if applicable)
• Featured listing or promotion fees (if applicable)
• Payment processing fees

Payment terms, payout schedules, and minimum payout thresholds will be detailed in the Seller Dashboard. We reserve the right to modify our Fee Schedule with 30 days' notice.

4.6 Taxes

Sellers are responsible for:

• Determining applicable sales tax requirements
• Collecting and remitting sales tax to appropriate authorities
• Reporting income for tax purposes
• Maintaining tax records as required by law

Harvest Hub Garden may provide tools to help calculate sales tax but makes no guarantees regarding tax calculation accuracy.

4.7 Order Fulfillment

Sellers are responsible for:

• Timely fulfillment of orders
• Maintaining product quality and freshness
• Safe packaging for food products
• Communicating with Buyers about order status
• Arranging pickup or delivery as specified in listings
• Addressing product quality issues

5. BUYER TERMS

5.1 Purchasing Products

When purchasing products through Harvest Hub Garden, Buyers agree to:

• Provide accurate payment information
• Complete the transaction process as described
• Comply with terms specific to each purchase
• Respect Sellers' policies regarding pickup, delivery, and returns

5.2 Payment Processing

Payments are processed through our third-party payment processors. By making a purchase, you authorize us to charge the payment method you provide. You represent and warrant that you have the legal right to use any payment method you provide.

5.3 Order Cancellations and Returns

• Order cancellation and return policies are set by individual Sellers
• Perishable products may have limited or no return options
• Buyers should review Seller policies before completing purchases
• Harvest Hub Garden may facilitate dispute resolution but is not responsible for processing returns or refunds directly

5.4 Food Safety Awareness

Buyers acknowledge that:

• Cottage foods are produced in home kitchens not subject to commercial food safety inspections
• Fresh produce may not have undergone commercial washing or processing
• Some products may contain allergens or be produced in facilities where allergens are present
• Proper food handling and storage is the Buyer's responsibility after purchase
• Local and seasonal products may vary in appearance from commercial counterparts

6. PLATFORM RULES AND RESTRICTIONS

6.1 Prohibited Activities

Users agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm other users
• Post false, misleading, or deceptive content
• Manipulate platform ratings or reviews
• Use the platform for unauthorized commercial solicitation
• Attempt to bypass our fee structure
• Scrape or harvest data from the platform
• Interfere with the proper operation of the platform
• Access or use the platform through automated means without our permission
• Sell prohibited items (detailed in our Prohibited Items Policy)

6.2 Food Safety Standards

All food products sold on the platform must:

• Comply with applicable cottage food laws or commercial food regulations
• Be prepared, stored, and handled in accordance with food safety guidelines
• Be properly labeled with ingredients and allergen information
• Not be potentially hazardous foods unless the Seller has appropriate commercial licenses
• Be truthfully represented regarding organic status, growing practices, and certifications

6.3 Content Guidelines

All content posted on the platform must:

• Be accurate and not misleading
• Not infringe on others' intellectual property rights
• Not contain hate speech, discriminatory language, or explicit material
• Not make unsubstantiated health or treatment claims about food products
• Respect others' privacy and confidential information
• Comply with our Community Guidelines

6.4 Verification and Monitoring

Harvest Hub Garden may:

• Verify Seller credentials and certifications
• Monitor listings for compliance with our policies
• Remove content that violates these Terms
• Suspend or terminate accounts that engage in prohibited activities

7. INTELLECTUAL PROPERTY

The Platform content, including its design, graphics, text, and other materials created by or for Harvest Hub Garden, is protected by copyright, trademark, and other laws. We and our licensors retain all rights to this content and the Platform.

7.2 Limited License to Users

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and view the Platform content solely for personal, non-commercial purposes.

7.3 User Content

You retain ownership rights in your User Content. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, distribute, publish, and process your User Content for the purpose of operating and improving the Platform and promoting Harvest Hub Garden.
